Regulations

§ 1 OBJECT OF THE REGULATIONS

1. Regulations define the rules for the provision of services, accountability and stay in the area of Residence and are an integral part of the Agreement, the conclusion of which takes place by signing the registration card, as well as by making a reservation and payment of the advance or the entire amount of stay in the Residence. By making the above mentioned activities, Guest confirms that he has read and that he accepts the Regulations.
2. Regulations apply to all guests staying in the “Nad Wodospadem” Spa & Wellness Residence.
3. Regulations are available at the reception of the Residence, in each apartment, as well as at the Residence website: www.nadwodospadem.eu

§ 2 HOTEL NIGHT

1. The apartments are rented for hotel nights.
2. A hotel night starts at 14:00 and ends at 12:00 on the next day. Please kindly check-in until 6 pm.
3. If a Guests wishes to extend a hotel night, he should inform the reception desk as soon as possible. The Residence may refuse to accept Guest’s request to extend his stay due to lack of free beds (apartments) or in case of Guests who do not comply with the Regulations.
4. The Residence reserves the right to refuse Guest’s request to extend his stay in the event of failure to make full payment for the current stay.

§ 3 BOOKING AND CHECK-IN

1. The basis for check-in of a Guest shall be a presentation of a photo ID to the front desk employee and signing the registration book.
2. Guest of the Residence shall not transfer the apartment to a third party, even if the period had not expired, for which he had paid a fee per stay.
3. Persons not registered in the Residence can stay in the Guest’s room from 7:00 to 21:00. Only by appointment.
4. The Residence may refuse to accept a Guest who had grossly violated the Regulations during the previous visit, in particular by inflicting damage to property of the Residence or property of other Guests, or personal injury of Residence employee or other persons residing in the Residence.
5. In some cases, the Residence reserves the right to charge a fee in advance for the stay.
6. Booking is considered guaranteed if an advance payment will be made in the amount of 30% of the whole amount per stay within 4 days from the date of making the reservation. Lack of advance payment may result in cancellation of Guest’s reservation.
7. In case of cancellation of a guaranteed reservation, Residence shall return the amount of the advance payment – if the cancellation was reported at least 7 days before the Guest’s arrival.
8. In case the Guest fails to arrive to the Residence before 18.00 on the date scheduled, the advance payment shall not be refunded and the booking is being cancelled (unless the parties agree otherwise).
9. In case if the Guest cancels his stay during a hotel night, the Residence shall not refund payment for the unused part of the stay.
10. If the guest cancels the reservation 3 days before the arrival, the accommodation will be charged for the whole stay.

§ 4 SERVICES

1. The residence provides services in accordance with its category and standard.
2. In case of any reservations regarding the quality of service, the Guest is asked to immediately report them to the reception, which will allow the Residence employees improving the standard of services provided.
3. The Residence has an obligation to provide guests:
– conditions for full and unfettered leisure,
– security of residence, including confidentiality of any information about the Guest,
– professional and courteous service for all services provided in the Residence,
– cleaning the room and performance of all the necessary repairs to equipment in the absence of the Guest, or in his presence – only at his request.
4. Additionally, at Guest’s request, the Residence provides the following free services:
– providing information related to the stay and travel,
– storage of money and valuables in the hotel deposit during the Guest’s stay in the Residence, subject to § 6. 4 of the Regulations,
– Guest’s luggage storage,
– ordering taxi.
5. It is also possible to transport the Guest from and to the airport, railway station, bus station – by a fixed mileage rate.
6. Meals are served at following times:
– Breakfast 8.00 – 9.30
– Lunch 14.00 – 16.00
– Diner 18.00 – 19.00
7. Spa&Wellness zone is available between 8.00 – 12.00 and 15.00 – 21.00.
8. Evening Bar:
– Monday – Thursday and Sunday20:00- 22:00
– Friday, Saturday – 20:00 – 23:00
Children under 12 years old are not allowed after 20:00 in the billiard room and bar.

§ 5 GUEST RESPONSIBILITY

1. Children under 12 years of age should stay in the area of the Residence under constant supervision of their legal guardians. Legal guardians assume full responsibility for any damage caused as a result of the children actions.
2. A hotel Guest assumes full responsibility for any damage or destruction of equipment and technical devices at the Residence and its environment arising from his fault or the fault of people visiting him. The Residence reserves the right to charge a hotel Guest for damages arising from his fault (verified during the stay in the facility) by adding the cost of repairs to the bill.
3. In case of violation of the Regulations, the Residence may refuse to provide services to a person that violated them. Such a person is obliged to immediately comply with the demands of the Residence, to pay the amount due for current services, to pay for possible damages and to leave the Residence.
4. Each time, a Guest leaving the room, shall – for safety reasons – turn off the TV, turn off the lights, turn off the taps and close the door.
5. The Residence has a statutory lien on the things brought by the Guest to the Residence in case of delay of payment per stay or unregulated charges for the services provided.

§ 6 LIABILITY OF THE RESIDENCE

1. The Residence shall be liable for any loss or damage of objects brought by persons using its services in the field specified by the provisions of the Civil Code.
2. Guests should notify the reception of the occurrence of damage immediately after it has been discovered.
3. The Residence is responsible for the loss or damage of money, valuables and jewellery only if these objects were placed for safekeeping at the Residence deposit.
4. The Residence reserves the right to refuse to accept high-value items, large sums of money, objects that endanger the safety and bulky items that can not be placed in the deposit to the hotel deposit.
5. The Residence shall not be responsible for damage or loss of a car or other vehicle belonging to the Guest, objects left by him and live animals, regardless of whether the vehicles were parked in the Residence parking lot or outside the Residence’s grounds.

§ 7 RETURN OF THE OBJECTS LEFT

1. Personal items left in the room by the Guest upon leaving shall be sent back (at the request of the Guest) to the indicated address, at his expense.
2. If the Residence receives no Guest’s disposal as for the items left, the Residence shall store these items – at the expense of the owner – for a period of three months, and after this period – these items will become the property Residence. Foodstuffs will be stored for 24 hours.

§ 8 CURFEW

The Residence curfew is from 22:00 to 7:00.

§ 9 COMPLAINTS

1. Guests have the right to complain in case of noticing deficiencies in the quality of the services provided.
2. All complaints shall be adopted at the reception.
3. The complaint should be filed immediately after noticing the deficiencies in the standard of services provided.

§ 10 ADDITIONAL PROVISIONS

1. The Residence and its immediate surroundings constitute a completely non-smoking area, except for the areas specifically designed for this purpose.
2. No dangerous goods – weapons and ammunition, flammable, explosive and illumination materials – shall be stored in the apartments.
3. Guest agrees to the storage and processing of personal data in accordance with the Act on the Protection of Personal Data (Journal of Laws of 2002. No. 101, item 926, as amended) by the “Nad Wodospadem” Spa & Wellness Residence, 58-570 Jelenia Góra, ul. Myśliwska 1 a, for purposes of the Guest’s stay in the Residence and his use of the other services provided by the Residence. The Guest has the right to access his personal data and to their correction.
4. It is prohibited to engage in the acquisition and direct selling activities at the Residence.
5. It is forbidden to make excessive noise, cause unpleasant odours, or other things that interfere with, damage or irritate other Guests of the Residence.
6. Guests are not allowed to make any changes to the apartments and their equipment, except for a minor furniture and equipment rearrangement that do not affect their functionality and safety of use.
7. Each apartment is equipped with pay mini-bar (price list available in the apartment). The hotel service shall verify the contents of the mini bar, complete its condition and add the missing items to the Guest’s account.
8. In the SPA zone – treatments are payable which are settled on the basis of the order card, carried out by the SPA employees.
9. Rules for using of the SPA zone are defined in the Regulations available in the SPA zone.
10. Rules for using the sports equipment rental are set out in separate Regulations (available at the reception).

§ 1 SUBJECT OF THE REGULATIONS

1. These Terms and Conditions set out the rules governing the provision of services, liability and the use of the Cottage premises, and form an integral part of the contract, which is concluded upon signing the registration form, as well as by making a booking and paying a deposit or the full amount due for the stay at the Cottage. By carrying out these actions, the Guest confirms that they have read and accept the terms of these Terms and Conditions.

2. These Terms and Conditions apply to all Guests staying on the indoor and outdoor premises of the Cottage and the Nad Wodospadem Residence.

3. These Terms and Conditions are available for inspection at the Cottage, as well as on the website www.nadwodospadem.eu

4. Guests are required to leave the Cottage in a tidy condition: dishes washed, rubbish and food waste collected, and any other unwanted items not belonging to the Cottage removed. Failure to do so will result in an additional charge of PLN 300, payable upon check-out.

§ 2 HOTEL DAY

1.The cottage is available for a minimum stay of 2 nights. Check-in is from 3 pm and check-out is by 11 am the following day. We expect guests to arrive by 6 pm.

2. Check-in is from 3.00 pm to 11.00 am. It is not possible to extend your stay. Exceeding the check-in time without prior agreement will result in an additional charge: up to 30 minutes – PLN 300, up to 1 hour – PLN 500, and for any time beyond that, the cost of one night’s accommodation.

§ 3 RESERVATION AND CHECK-IN

1. To check in, guests must present a photo ID to a member of staff at the Residence’s reception and sign the registration form.

2. A guest of the Cottage may not transfer the Cottage to third parties, even if the period for which they have paid the accommodation fee has not yet expired. In the event of a stay by persons not included in the booking and not registered for check-in, a penalty of PLN 300 per day per person applies.

3. Persons not registered at the Cottage may visit between 7:00 and 18:00 by prior arrangement only.

4. The Residence may refuse to admit a Guest who, during a previous stay, grossly breached the rules and regulations, in particular by causing damage to the property of the Cottage and the Residence or to the property of Guests, or by causing injury to a Guest, an employee of the Residence or other persons staying at the Residence.

5. A booking is considered guaranteed if a deposit of 30% of the total amount is paid within 4 days of the booking being made. Failure to pay the deposit may result in the cancellation of the booking.

6. In the event of cancellation of a guaranteed booking up to 14 days prior to arrival, the Residence will not refund the deposit.

7. If the Guest does not arrive at the Cottage by 6:00 pm on the scheduled date, the booking will be cancelled (unless otherwise agreed by the parties).

8. In the event of the Guest leaving during the stay, the deposit is non-refundable.

9. The remaining amount for the stay shall be paid on the day of arrival when collecting the keys.

§ 4 GUESTS’ LIABILITY

1.Children under the age of 15 must be under the constant supervision of their legal guardians whilst on the premises of the Cottage. Legal guardians are financially liable for any damage caused by the children. Children under the age of 15 are not permitted on the premises of the Residence without their legal guardians.

2. The tenant of the Cottage bears full financial liability for any damage or destruction to the furnishings and technical equipment of the Cottage and its surroundings caused by their own fault or that of their visitors. The Residence reserves the right to charge the Tenant for damage caused by their fault (verified during their stay at the property) by adding the repair costs to the bill.

3. In the event of a breach of these terms and conditions, the Residence may refuse to provide services to the person responsible for the breach. Such a person is obliged to comply immediately with the Residence’s requests, settle any outstanding charges for services provided to date, pay for any damage caused, and vacate the Residence/Cottage.

4. The guest is obliged to pay for any material damage in full, based on the cost estimate presented by the Residence.

§ 5 RETURN OF LOST PROPERTY

1. Personal belongings left in the hotel room by a departing guest will be returned to the address provided, at the guest’s expense.

2. In the absence of instructions from the guest, any items left behind will be stored for a period of three months at the owner’s expense, and after this period they will become the property of the Residence. Food items will be stored for 24 hours.

§ 6 ADDITIONAL PROVISIONS

1. Smoking of tobacco and other substances is strictly prohibited within the Cottage and its immediate surroundings, except in designated areas set aside for this purpose.

2. There is a strict and absolute ban on lighting fires in the Cottage and its immediate surroundings.

2. The guest consents to the storage and processing of personal data in accordance with the Personal Data Protection Act by the Nad Wodospadem Spa & Wellness Residence.

3. Door-to-door sales and canvassing are prohibited on the premises of the Cottage and the Residence.

4. It is forbidden to make excessive noise on the premises of the Cottage and the Residence, to cause unpleasant odours, or to engage in any other behaviour that disturbs, harms or irritates other Guests.

5. Guests are not permitted to make any alterations to the Cottage or its furnishings, apart from minor rearrangements of furniture and fittings that do not compromise their functionality or safety.

6. Cleaning of the Cottage is available only upon the Guest’s request, at an additional charge of PLN 150 per cleaning. Please notify reception one day in advance if you wish to use this service.

7. If you wish to use the sauna in the Cottage, please notify us by telephone between 08:00 and 18:00, at least 4 hours in advance. The cost of the sauna is PLN 150 per day.

Terms and conditions for purchasing a voucher

TERMS AND CONDITIONS FOR THE PURCHASE AND REDEMPTION OF VOUCHERS AT THE NAD WODOSPADEM SPA & WELLNESS RESIDENCE

1. ‘Gift voucher’ - a document issued by the Hotel, enabling the use of the Hotel’s services (accommodation, meals) for the person named therein, for an amount corresponding to the voucher’s face value, subject to prior payment of the amount corresponding to the voucher’s value and following the prior booking of services, in accordance with the provisions of these Terms and Conditions.

2. ‘Voucher Purchaser’ – any adult natural person or legal entity who has purchased a voucher and, as a result, holds a voucher issued by the Residence and accepts the provisions of these Terms and Conditions.

3. ‘Redeeming the voucher’ – the exchange of the voucher by the person named on the voucher for hotel services offered by the establishment corresponding to the value of the voucher, in accordance with these Terms and Conditions.

4. PURCHASE OF THE VOUCHER

4.1. The condition for the issue of a voucher is payment by bank transfer to the bank account specified by the establishment or at the reception of the Rezydencja Spa&Wellness nad Wodospadem.

4.2. Upon payment for the voucher, the establishment shall send the original voucher, together with the voucher number and expiry date, to the address provided by the Purchaser.

4.3. The person named on the voucher must present the original voucher at check-in in order to receive the relevant services.



4.4. Types of voucher. A voucher may be purchased for hotel services (accommodation in a specific type of room or suite, meals), or in the form of a specific monetary value to be used for accommodation and meals.


5. REDEMPTION OF THE VOUCHER


5.1. The voucher entitles the person named therein to exchange it for the services purchased by the purchaser/holder of the voucher. The Hotel’s provision of services is subject to prior booking of accommodation at the Hotel and written confirmation of such booking by the Hotel.


5.1. Reservations for the relevant services (accommodation, meals) at the Hotel should be made: by telephone on 508 501 125, 533 555 627, by email: rezerwacje@nadwodospadem.eu, or in person at the Hotel. The booking is considered confirmed once the person named on the voucher has received an email from the Hotel confirming the booking.


5.2. The person named on the voucher must present the original voucher in order to receive the relevant services.


5.3. The voucher is not a means of payment, is not exchangeable for cash, and no change can be given in respect of it.

6. VALIDITY PERIOD OF THE VOUCHER

6.1. The voucher may be redeemed within 6 months of the date of issue during its validity period, provided that a booking for the stay has been made in advance.

6.2. Vouchers cannot be redeemed during periods when special offers are in force at the property, e.g. Christmas and New Year’s Eve, Easter, long weekends, etc.




6.3. The voucher may be used only once and cannot be split into parts.


6.4. Any voucher not used within its validity period will expire.


7. FINAL PROVISIONS


7.1. These terms and conditions are available at the Spa&Wellness Residence by the Waterfall, or on the website www.nadwodospadem.eu


7.2. Rezydencja Spa&Wellness nad Wodospadem is not liable for lost or damaged vouchers.


7.3. These terms and conditions are deemed to have been accepted by the purchaser of the voucher upon payment for the voucher.
